Locale DAO, LLC, a Wyoming Decentralized Autonomous Organization Limited Liability Company (“Locale DAO,” “we,” “us,” or “our”) values the privacy of its Members, Users, Contributors, visitors, and other stakeholders (“you” or “your”). This Privacy Policy governs the collection, use, disclosure, retention, and protection of Personal Information through our website, Protocol, Smart Contracts, and related services (collectively, the “Platform”).

This Policy is designed to comply with:

  • The Federal Trade Commission's Fair Information Practice Principles (notice, choice, access, security, enforcement);
  • Federal privacy statutes as applicable (e.g., COPPA, GLBA, HIPAA);
  • Wyoming laws, including absence of comprehensive state privacy, but adherence to sectoral requirements (e.g., public record laws, COPPA exempt status);
  • Privacy requirements under CalOPPA and similar laws for users in California.

2. INFORMATION WE COLLECT

2.1. Personal Information.

We may collect:

  • Identifiers: e.g., name, email, mailing address, phone number.
  • Blockchain identifiers: public wallet addresses, transaction hashes.
  • Platform usage data: IP address, browser type, device, access times, cookies.
  • Community participation details: forum contributions, feedback, votes, proposals.

2.2. Sensitive Information.

We do not intentionally collect financial account or health-related data. Devise with caution: any inadvertent data you submit like income or health information may be incidentally processed but will be managed per applicable law.

2.3. Children.

Our Platform is not directed to children under 13. We do not knowingly collect such data. If discovered, it will be deleted in compliance with COPPA.

3. USES OF INFORMATION

We may use your Personal Information:

  • To provide and maintain the Platform, governance services, smart contract operations;
  • To verify identity for KYC/AML compliance if applicable;
  • For communication: notifications, updates, proposals, support;
  • To analyze and improve Platform performance;
  • To comply with legal obligations, judicial orders, law enforcement requests;
  • To protect rights, safety, property of Locale DAO, its Members, and the public;

4. SHARING & DISCLOSURE

4.1. With Service Providers & Partners.

Third-party vendors that support Platform operations (e.g., email, analytics, smart contract auditors) receive only the data necessary to perform their function, under binding confidentiality and security obligations.

4.2. Legal Compliance.

Personal Information may be disclosed if required by subpoena, court order, or law enforcement; to defend rights; or to enforce compliance with agreements.

4.3. Business Transfers.

In event of a merger, acquisition, or sale of assets, Personal Information may be transferred. You will be notified and afforded rights to control your information.

4.4. Public Blockchain Data.

Any data recorded on-chain via Smart Contracts is visible on public blockchains and outside our control. This Policy does not apply to such data.

5. CHOICES AND YOUR RIGHTS

5.1. Opt‑In/Opt‑Out.

Where legally required (e.g., CalOPPA), you may opt‑in or opt‑out of non-essential data collection or sharing.

5.2. Access, Correction, Deletion.

You have the right to request review, correction, or deletion of your Personal Information. Submit a request via email (see Section 12). We'll respond within 30 days unless otherwise mandated.

5.3. Cookies & Tracking.

You may disable cookies or analytics tracking via your browser, though this may affect Platform usability.

6. DATA RETENTION & SECURITY

6.1. Retention Period.

We retain Personal Information as long as necessary for the purposes outlined in this Policy and to meet legal obligations (e.g., tax, anti‑fraud, contract).

6.2. Security Measures.

We implement technical, administrative, and organizational protections in line with industry standards to protect your data integrity and confidentiality. However, no system is entirely fail-proof—therefore, disclosures due to breach or attack are possible.

7. INTERNATIONAL TRANSFERS

Locale DAO is based in the U.S. Data may be transferred to or accessed in other jurisdictions. You consent to cross-border transfers subject to this Policy.

8. CALIFORNIA RESIDENTS

Under CalOPPA, residents must be informed of:

  • Categories of Personal Information collected;
  • Where such information is shared;
  • Mechanism to review and update Personal Information;
  • Opt‑out rights; and
  • Effective date of this Policy.

9. WYOMING & FEDERAL REQUIREMENTS

9.1. Public Records & State Disclosure.

Personal data collected via state filings may be subject to Wyoming public records laws.

9.2. Sectoral Compliance.

While Wyoming lacks a comprehensive consumer data privacy law, we adhere to federal law obligations (e.g., COPPA, GLBA, HIPAA) where applicable.

10. POLICY CHANGES

We may modify this Policy to reflect new legal or operational changes. Revised versions are effective upon posting, and your continued use indicates consent.
